Il fatto è che ad oggi da un punto di vista giuridico la Sardegna si trova quasi del scoperta, priva di un potere decisorio vero sulla materia e come tale riconosciuto dalla Stato. Per assurdo, se qualcuno decidesse di circondare tutto il mare di Sardegna di pale eoliche a poche centinaia di metri dalle coste o a qualche Km dalla battigia secondo un interpretazione della legislazione vigente in materia potrebbe pure farlo, con una semplice autorizzazione ministeriale.
Le procedure di autorizzazione per la realizzazione di impianti eolici off shore sono disciplinate dall’art 12 of Legislative Decree 29 December 2003, 387 "Implementation of Directive 2001/77/EC on the promotion of electricity produced from renewable energy sources in the internal electricity market", as amended. In paragraph 3 of Article 12. on "Rationalisation and simplification of permitting procedures," it reads as follows: For the offshore license is granted by the Ministry of Transport, in consultation with the Ministry of Economic Development and the Ministry of the Environment, Land and Sea , in the manner described in paragraph 4 and after obtaining the use of the maritime domain by the competent maritime authority and .... the authorization 'issued following a single procedure, which involves all relevant government departments, conducted in accordance with the principles of simplification and in the manner' prescribed by law August 7, 1990, No 241 and subsequent amendments. The authorization is right to construct and operate the plant in compliance 'with the approved project ... .. The deadline for completion of proceedings under this subparagraph shall not 'be no more than one hundred eighty days.
In 2007 with the Budget Law of the Prodi government ('art. 2, c. L.24 158 of December 2007, No. 244, entitled "Provisions for the formation of the annual budget and multi-state (Law Financial, 2008) ", published in the Official Gazette 300, 28/12/2007 - Suppl. Dunque, ad oggi, la situazione è questa : l'art. 27, comma 44, della legge 99/2009, riscrivendo il comma 4 dell'art. 12 del D.Lgs. 387/2003, fa venir meno, in caso di dissenso nel rilascio delle autorizzazioni, la competenza della Regione a decidere sul rilascio delle autorizzazioni.
Ad oggi , quindi, sulle procedure di autorizzazione il solo titolato a decidere è il Ministero dei trasporti, sentiti il Ministero dello sviluppo economico e il Ministero dell’ambiente e della tutela del territorio e del mare, previa concessione d’uso del demanio marittimo da parte della competente autorità marittima. In definitiva quindi la Regione Sardegna non ha strumenti giuridici a disposizione per impedire il rilascio di autorizzazione da parte del Ministero dei Trasporti. E’ perciò in astratto possibile circondare il perimetro delle coste del mare della Sardegna di torri con pali eoliche senza che la Sardegna al di là della strumenti della pressione politica possa giuridicamente fare qualche cosa.
Tuttavia, la riscrittura della legge del 2003 operata dal Governo Berlusconi potrebbe presentare profili di incostituzionalità poiché fa venir meno la competenza a decidere, in caso di parere contrario all’insediamento , della Regione. Questo si può dire se si segue la logica e la motivazione della sentenza di una sentenza della The Constitutional Court No 88/2009 of the Constitutional Court, Judgement intervened at the request raised by the Region of Tuscany, who thought the 2003 legislation affecting the regional powers. All'articolo 13 si della legge si dichiara: il mare territoriale, per la sua stretta interrelazione con le aree tutelate ai sensi degli articoli 142 e 143 del decreto legislativo n. 42 del 2004, e successive modifiche ed integrazioni, di primario interesse paesaggistico. Rimane il fatto che la Regione avrebbe dovuto impugnare nei termini la legge dello Stato e, purtroppo, ha omesso di farlo.
Stabilisce poi che “la Regione considera meritevoli di tutela, e ne fa oggetto di integrale conservazione, le praterie di posidonia, secondo anche quanto previsto dalla direttiva comunitaria n. 92/43/CEE del 21 maggio 1992, relativa alla conservazione degli habitat naturali e seminaturali e della flora e della fauna selvatiche, e ne costituiscono "habitat prioritario" vietando qualunque intervento che possa comprometterne l'integrità ovvero lo stato di equilibrio ottimale dell'habitat naturale.

FEATURES Puglia projects (two in the province of Foggia e uno in quella di Brindisi) sono del tutto simili alla proposta presentata in Sardegna: stesso modello di pale eoliche (il V90, della potenza di 3 megawatt ciascuna), realizzate dalla società Vestas, con un'emissione acustica nominale dichiarata (alla velocità di riferimento di 8 metri al secondo) di 109,4 decibel. Numeri importanti, che la Regione Puglia avrebbe voluto approfondire in una conferenza dei servizi su base locale.
LA SITUAZIONE A oggi in Italia e in tutto il mar Mediterraneo non esistono impianti eolici off-shore in funzione. Nella Penisola sono in fase avanzata di autorizzazione sei impianti, di cui uno sperimentale in acque profonde in Sicilia.
