PORCU MOTION - BRUNO - URAS - SALIS - AGUS - BARRACCIU - BEN AMARA - CARIA - COCCO Daniele Second - Peter COCONUT - CUCCO - cuckoo - DIANA Giampaolo - ESPA - LOTTO - MISSING - MARIAN - Marco MELONS - Valerio MELONS - Moriconi - SABATINI - SANNA Gian Valerio - SECHE - Antonio Solinas - SORU - Massimo Zedda - Zuncheddu on increased demand to the competent administrations of wind farms in the territory of Sardinia and the need to link the granting of permits to the actual energy needs of Sardinia and compatibility with careful preservation of environmental values, natural, historical and cultural territory of Sardinia, with a request to convene Extraordinary Council pursuant to paragraphs 2 and 3 of Article 54 of the Rules.

THE REGIONAL COUNCIL
CIRCUMSTANCES that support for all production of energy from an alternative source fuels must be compatible conjugate with careful preservation of environmental values, natural, scenic, historical and cultural of the Sardinian territory and must be functional to the actual energy requirements of Sardinia;
CONSIDERING that:
- recently there has been an increase in requests made to the competent government of wind farms, both land and offshore areas, the heaviest environmental impact, such as off the coast of the Sinis Is Arenas Renewables Energies Ltd (headquarters: Bosa, 08013, via Azuni No. 23) consists of 80 wind towers 130 meters high ( 100 above the water), 320 MW of maximum area of \u200b\u200b21,698,062.00 square meters in the territorial sea (2 to 8 km from the coast) and the Sinis 450 square meters on the maritime domain, in the coast of Is Arenas , Pallosu, S'Archittu in the towns of San Vero Milis, Narborough, Cuglieri (OR);
- to intervene for its heavy implications landscape and significant impact on tourism and on fishing activities has aroused strong opposition from the community local and institutional representatives at all levels;
- the sun and wind are common property to be considered public property and their exploitation is aimed to provide concrete benefits for the Sardinian population in terms of reduction of energy costs and emissions reduction pollutants;
- the issuing of permits for construction of wind farms in land is among the regional powers (Article 12 of Legislative Decree No 387 of 2003), while the granting of permits for the construction of wind farms in the territorial sea is among the national powers (Ministry of Infrastructures and Transport, Article 12 of Legislative Decree No 387 of 2003);
- With No Decision of the Regional 28/56 of 26 July 2007 were identified in the relevant guidelines for the construction of wind farms (Article 112 of the NTA PPR - Article 18, paragraph 1, of Law May 29, 2007, n. 2);
NOTED that:
- To date, wind farms installed in Sardinia and those already approved largely cover the potential for effective use of the Sardinian power grid and any subsequent approval would not require a reduction in the activities of traditional power plants and their emissions of pollutants and CO2
- the technology of wind turbines is now a mature technology with no entrepreneurial risk and state incentives make some cheap annual revenues on the basis of energy alone produced even if not used;
- by virtue of this legislative change the regional licenses for the construction of new wind farms are no longer required to be issued after public announcement, but may be assigned without any links to the actual energy needs of Sardinia with the risk of a serious loss of fees in favor of the Autonomous Region of Sardinia and an unnecessary environmental impact
NOTED that:
- Article 6 of Regional Law No 3 of 2009, has fully replaced Article 18 of Law No regional 2 of 2007, the discipline and the construction of additional wind farms in the region by deleting, in a totally unexpectedly, the obligation of issuing permits to operate new facilities through public selection procedures based on the actual energy needs of the territory Sardinia as contained in the PEARS (Decision of the Regional No 66/24 of 27 November 2008);
- in any case, the construction of wind farms is subject to the budget and binding (article 29 of Legislative Decree No 152 of 2006 and subsequent amendments and supplements) a procedure for environmental impact assessment (Article 20 of Legislative Decree No 152 of 2006 and subsequent amendments thereto, Annex IV, paragraph 2, letter e), Article 31 of Law No 1 of 1999 and subsequent amendments and supplements, deliberation of the Regional No 24/23 of 23 April 2008, Annex A1, 3), while the construction of wind farms in marine areas is subject to the budget and binding (article 29 of Legislative Decree No 152 of 2006 and subsequent amendments thereto, Law 99, 2009) procedure for environmental impact assessment (Article 20 of Legislative Decree No 152 of 2006 and subsequent amendments thereto, Annex II, paragraph 7 a),
commits the President of the Region and the Regional
1) to bind tightly to issue new permits for the construction of wind farms:
a) real and genuine energy needs of the region of Sardinia as contained in the PEARS;
b) a public selection procedures (calls) Contemplative forms of remuneration in the energy and / or monetary policy in favor of the Sardinia Region and local authorities concerned and to stop issuing new permits until the final approval of the study specifically provided for in the Regional Landscape Plan (Article 112 of Technical implementation) and by 'Article 18 of Law No 2 of 2007, as amended by Article 6 of Regional Law No 3 of 2009;
2) to require the national government to issue new permits for the construction of wind farms in the territorial sea of \u200b\u200bSardinia being subject to the understanding / agreement with the Autonomous Region of Sardinia, under Article 56 of Decree of President of the Republic No 348, 1979 (Special Provisions for the enforcement of the Statute for Sardinia), to be determined solely on the basis of the actual needs of the energy contained in Sardinia PEARS.
